Terms of Service

Time Locker provides an innovative and practical network of smart parcel lockers designed to enhance the process of parcel delivery, pickup, and dispatch. Our Services offer users flexibility and security for their shipments, whether as recipients, senders, property owners, or business entities.

Our Services include, but are not limited to:

• Access to and use of Time Locker parcel lockers: secure physical delivery and retrieval of parcels through our network of smart lockers located on private, public, and commercial premises.
• Time Locker mobile application: a user-friendly platform for managing parcels, delivery status notifications, remote locker access, shipment history tracking, and scheduling of dispatch or returns.
• Time Locker website: a centralized hub for service information, FAQs, technical support, terms of use, privacy policies, and user account management.
• Partner services and integrations: collaboration with delivery services, e-commerce platforms, and property managers to support seamless logistics and an expanded locker network.

To fully utilize our Services, particularly for parcel pickup and dispatch, you must create and maintain an active user account.

You agree to:

• Provide accurate information: submit true, current, and complete information during registration and use, including your name, address, contact details, and payment information. You must promptly update your account with any changes.
• Maintain confidentiality and security: keep your password and login credentials secure. You are solely responsible for all activity on your account, authorized or not. Notify us immediately of any unauthorized use or security breach.
• Use one account per person: each user may maintain only one account. Operating multiple accounts to circumvent obligations or manipulate the system is strictly prohibited and may result in permanent suspension.
• Meet the age requirement: Services are available only to individuals of legal age.

Use of Time Locker parcel lockers is subject to the following rules:

• Legal shipments only: lockers may only be used for legal and permitted items. Illegal, dangerous, flammable, explosive, corrosive, toxic, radioactive, narcotic, counterfeit, or perishable goods, as well as weapons, live animals, or items violating Croatian or EU law, are strictly prohibited.
• Size and weight limits: parcels must conform to size and weight restrictions specific to the chosen locker compartment. Time Locker reserves the right to reject, remove, or dispose of non-compliant items and may charge associated fees in accordance with applicable laws.
• Pickup time limits: parcels must be retrieved within the time specified in your notification, usually 48 hours from delivery. Unclaimed parcels may be removed and stored temporarily, incurring storage fees. After a grace period, such as 7 days, unclaimed parcels may be returned or disposed of with applicable charges.
• Liability for parcels: Time Locker is responsible for the physical security of parcels only while stored in a locked compartment. Liability ends when the locker is opened by the user or retrieved by an authorized courier. We are not responsible for parcel content, nor for loss or damage before locker deposit or after retrieval.
• Damage to lockers: users are liable for any damage caused to lockers or infrastructure through misuse, negligence, or intentional actions. Time Locker reserves the right to charge repair or replacement costs.
• Force majeure: we are not responsible for service disruptions due to force majeure events, power outages, telecommunications failures, natural disasters, or other causes beyond our control. We will make reasonable efforts to restore normal operations.

Certain Time Locker Services may incur fees. All applicable charges, whether one-time, subscription-based, or per-transaction, will be clearly indicated in the app, on the website, or during service ordering.

• Payment consent: by using paid Services, you agree to pay all associated fees and applicable taxes.
• Payment methods: we accept credit/debit cards and other digital payment methods as indicated. Payments are processed securely through third-party providers. We do not store full card details.
• Price changes: we reserve the right to modify pricing or fee structures at any time. Users will be notified in advance, such as 30 days prior, via app, email, or website. Continued use of Services after changes become effective constitutes acceptance.
• Storage and return fees: additional charges may apply for unclaimed, non-compliant, or returned parcels as described in these Terms.

We value your privacy and process personal data in compliance with the General Data Protection Regulation (GDPR) and relevant Croatian law.

Please refer to our Privacy Policy, which forms an integral part of these Terms, for details on data collection, usage, storage, protection, and your rights.

By using our Services, you consent to our processing of your data as outlined in our Privacy Policy.

All content, features, and functionalities made available through our Services, including but not limited to text, graphics, logos, icons, images, videos, software, and system design, are the exclusive property of Time Locker d.o.o. or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

This license does not permit:

• Resale or commercial use of Service content.
• Use of data mining or extraction tools.
• Use of Service content in derivative works.
• Downloading or copying account data for the benefit of another business.
• Reproduction or distribution of Time Locker content without written permission.

Our Services are provided as is and as available without warranties of any kind, express or implied. Time Locker and its affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your access to or use of the Services.
• Actions or content of third parties, including couriers or other users.
• Content obtained via the Services.
• Unauthorized access to or alteration of your data.
• Service interruptions due to technical issues.
• Loss or damage to parcels outside of Time Locker custody as defined in these Terms.

These limitations apply regardless of the legal basis for the claim, even if we were advised of the possibility of such damages.

You agree to fully indemnify, defend, and hold harmless Time Locker d.o.o., its affiliates, directors, officers, employees, and partners from any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

• Your use of the Services.
• Violation of these Terms.
• Infringement of third-party rights.
• Damage to lockers caused by you.
• Any content you submit through the Services.

We reserve the right to amend or replace these Terms at any time at our discretion.

• Notice of changes: if changes are material, meaning they significantly affect your rights, we will notify you via the app, email, or website at least 30 days in advance.
• Materiality determination: what constitutes a material change is solely at our discretion.
• Acceptance: continued use of Services after changes take effect constitutes your binding acceptance. If you do not agree, you must discontinue use.

We may suspend or terminate your access to the Services immediately, without notice, if:

• You breach any part of these Terms.
• We suspect fraudulent or unlawful activity.
• We deem it necessary to protect the security or integrity of the Services.
• Your account remains inactive for an extended period.

You may also terminate your account at any time via the app or website. Provisions that naturally survive termination, including intellectual property, indemnity, and limitations of liability, shall remain in effect.

These Terms and any disputes arising from or related to them shall be governed by the laws of the Republic of Croatia, without regard to conflict of law principles.

Any legal action shall fall under the exclusive jurisdiction of the Municipal Court in Osijek, Croatia.
